This document defines the Service Level of Disks (“Service”), and is an integral part of Nebius Services Agreement (“Agreement”) and SLA available at: https://docs.nebius.com/legal/sla. Capitalized terms used herein but not defined herein shall have the meanings set forth in the Agreement and Linked Documents.

Compensation Amount

Service Uptime Percentage is measured separately for each Disk, so the compensation is provided for each Disk separately.

Definition of Service Unavailability

A Disk is considered Unavailable during any two-minute interval in which either (i) for at least one request type (read or write), at least one request was Outstanding and every such request failed with an Error or was Hung, or (ii) the Disk was in the “ERROR” state as displayed in the Management Console for the entire interval. In all other two-minute intervals in which the Disk exists, the Disk is considered Available. Service Uptime Percentage for a Disk in a Reporting Period is calculated as the number of two-minute intervals in which the Disk was Available divided by the total number of two-minute intervals in which the Disk existed in the Reporting Period, multiplied by 100%. A Disk exists from the creation until the deletion of the corresponding resource in the Nebius API, including while it is detached or the Virtual Machine to which it is attached is stopped. The following do not constitute Unavailability of a Disk: (a) unavailability of a Virtual Machine itself, which is covered by the Service Level for Compute Cloud; (b) inability to perform operations caused by Customer-side configuration, including guest OS settings, partitioning or file systems created by Customer on the Disk, or detachment or deletion of the Disk by Customer or by software acting on Customer’s behalf; (c) performance below the published maximum bandwidth or IOPS values, provided that read and write operations complete; published performance values are upper bounds and do not constitute a warranted service level; (d) failures of individual operations caused by Customer reaching the capacity of the Disk or the Quotas and Limits established for the Service; (e) unavailability of non-replicated Disks and local disks, which are not covered by this Service Level; (f) circumstances listed in Section 3 (Exclusions) of SLA.

Definitions

Disk means virtual block device that can be attached to a Virtual Machine in the same Region, as defined in the Terms of Use. A request is Outstanding at a given point in time if it was submitted but had received no response, success or error, by that point. A request is Hung if it was Outstanding for the entire duration of the two-minute interval. Error means input/output error, as declared in <linux/errno.h>
