The personal data controller:
Nebius B.V. (potential employer or client), with registered office at Gustav Mahlerlaan 300, 1082 ME, Amsterdam, the Netherlands, e-mail: privacy@nebius.com, processes personal data for the below stated purposes in compliance with the General Data Protection Regulation (“GDPR”) based on your consent.
The Purpose #1 of the processing is to allow the data controller, acting as a potential employer/potential client, to use an AI-powered tool to assess your interview performance. Specifically, the tool will: (1) record the audio and video of your interview, (2) create a transcription of the interview content, and (3) analyze specific aspects of your answers to the questions script for the specific position. This candidate report will be used by recruiters and/or hiring managers in evaluating your suitability for the position.
The Purpose #2 of the processing is to register you in the list of job applicants and to offer other suitable job opportunities and/or contract-based opportunities. The benefit for you is that some of the interview rounds conducted in the past will be deemed successfully absolved also with respect to future opportunities.
The provision of this consent is fully voluntary. You may choose to provide consent for both purposes, or neither of the purposes.
Your choice will not negatively affect your application or how it is evaluated in any manner. You have the right to withdraw your consent at any time.
Please note that Art. 22 GDPR does not apply to this activity since the AI tool only conducts narrow procedural tasks (organizing recording and transcripts of your answers to your answers as per script of questions for the specific position. This activity does not contain any profiling or automated decision making as specified in the GDPR.
The data controller retains the personal data for the recruitment purpose for as long as this consent lasts, up to a maximum of two (2) years.
Under the GDPR, you enjoy the following rights as a data subject:
(i) the right of access to your personal data;
(ii) the right to rectification or completion of personal data;
(iii) the right to restriction of processing;
(iv) the right to erasure of personal data (except for those personal data that are necessary for compliance with financial, tax and other legal obligations to which the controller is subject, as well as for the establishment, exercise or defense of legal claims),
(v) the right to object to processing on the basis of legitimate interests or for direct marketing purposes;
(vi) the right to data portability;
(vii) the right to withdraw consent to the processing of personal data at any time, with future effects (withdrawal of such consent does not affect the lawfulness of the processing of personal data based on consent given prior to its withdrawal);
(viii) the right to receive a copy of the standard contractual clauses;
(ix) the right to lodge a complaint directly with the Dutch Data Protection Authority (or any other Data Protection Authority based on your residence), located at Dutch Personal Data Authority, PO Box 93374, 2509 AJ The Hague, the Netherlands.
